管辖司法机关或行政执法机关在案件受理范围上的分工。由于管辖范围的划定，便产生了不同的管辖权：
1.级别管辖。指应该属基层管理内的案件，上一级机关就不能越级直接查办；
2.地域管辖。指各行政执法机关所在地的管辖范围权力。
3.移送管辖。指某执法机关按分工无权办理的案件，而有权转送有关管辖单位办理。

工商行政管理机关对投机违法案件的管辖，主要是根据案件的查获地来确立的，原则上是由先查获地的工商行政管理机关管辖。工商行政管理机关就管理问题发生争议时，可由争议双方的直接上一级工商行政管理机关协商指定管辖。人民法院对自己有管辖权的案件，有权也有义务进行审判，对于本法院没有管辖权的案件，无权受理，被告人也有权拒绝应诉。
