财产租赁合同出租人将属于自己所有的财产交付承租方使用，承租方为此支付一定的租金，并在租赁期满后，将承租的财产返还给出租方的协议。财产租赁合同的特征:①财产租赁合同关系不发生所有权的转移，即承租方在合同关系存续期间内享有对租赁标的物的占有权和使用权，而所有权仍属于出租方。②财产租赁合同的标的物要求是法律允许叮供出租的财产，是不能被消耗掉的特定物。由于在租赁合同终止时，承租方要把原租赁的财产返还给出租方，因此租赁合同的标的物必须是非消耗物。一次性消耗物不能作为财产租赁的标的物。③财产租赁合同虽然属于债权关系，但也具有某些物权的特征。在租赁合同关系存续期间，如果出租方将租赁标的卖给第三人，则租赁合同仍然有效。 财产租赁合同当事人的权利和义务:①出租方有权按照国家或合同规定的收费标准，向承租方收取租赁费;有权按照合同规定的时间和标准，将出租的财产交给承租方使用;除法律和合同另有规定者外，出租方应负责对租赁物的修理，以保证租赁物在合同期内正常使用。②承租方按照合同规定的期限和数额向出租方交付租赁费;应正当、合理地使用租赁财产，不得擅自转租、拆毁、改装或作其他改变;应按照约定的期限返还承租的财产。
