| 担保 secure 债务人以外的人对出票、背书、承兑等票据行为所发生的债务予以保证的附属票据行为。实行担保的目的是为了增加票据的可靠性，提高票据的信用度。票据的担保人为票据债务的履行而提供担保时，应在票据上写明保证的意旨并签章，还应在票据上记载被担保人的姓名。未载明被担保人姓名时，未经承兑的票据以出票人为被保证人，已承兑的以承兑人为被保证人。票据担保人的责任具有两重性。其一为从属性，表现在担保人的债务从属于被担保人的债务，与被担保人负有同一责任，对持票人负连带责任。为出票人担保的，要担负保证承兑或保证付款的责任；为承兑人、背书人担保的，要担负保证付款的责任。其二为独立性，表现在当被担保人不能履行义务时，担保人应负履行义务的责任。即使被担保人的债务无效，担保人仍要担负票据上的责任，除非被担保人的债务因票据要式上的欠缺而无效时，担保人的债务才随之无效。票据担保人在偿付票据后，即可行使持票人的权利。 |
