The legitimate sources of freedom and rights in western countries include two types:the former is the exterior of the state power,which can be confirmed but not created by the state power;the latter is the interior of the state power,which can be created and conferred thereby.

| 言论自由 speech，freedom of 一国公民通过语言表述各种思想和见解的自由。一国宪法规定的公民基本权利之一。包括口头和书面等表述形式。广义的言论自由还包括新闻、出版、著作、绘画等自由。 资产阶级启蒙思想家在反对封建专制制度的斗争中，提出了言论自由的口号。岩爆破坏堵塞公路1789年法国《人权与公民权宣言》把言论自由作为人权的最重要的内容之一加以规定。1791年美国宪法修正案第一条也把言论自由列为首要的公民权。其后各国在资产阶级革命胜利后都用宪法的形式赋予公民以言论自由。在中国，宪法确认公民享有言论自由。但同时规定，公民在行使言论自由权利时，不得破坏社会秩序，不得违背宪法和法律，不得损害国家的、社会的、集体的利益或其他公民的合法的自由和权利。
