| 合同工 contract worker 企业、事业单位通过签订合同招收的短期性工人。合同一般采取书面形式，内容包括时限、任务及共同遵守的各项义务等。1986年中国用工制度改革以后招收的各类工人一般都是合同工。1986年7 月12日，国务院发布《国营企业实行劳动合同制暂行规定》和《国营企业招用工人暂行规定》，指出企业在国家劳动工资计划指标内招用常年性工作岗位上的工人，除国家另有特别规定者外，统一实行劳动合同制。企业招用合同工采取公开招收、自愿报名、德智体全面考核、择优录用的原则。合同工与所在单位固定工享有同等的劳动、工作、学习、参加企业民主管理、获得政治荣誉和物质鼓励等权利。国家对劳动合同制工人退休养老实行社会保险制度。退休养老基金由企业和劳动合同制工人缴纳，退休养老金不敷使用时，国家给予适当补助。实行合同工制的根本目的在于，打破铁饭碗、大锅饭，真正实行各尽所能、按劳分配，充分调动劳动者的生产积极性，提高企业劳动者的素质。 |
