双务合同根据合同双方当事人的权利和义务，将合同分为双务合同与单务合同。双方当事人互负对待给付义务的合同，为双务合同；当事人一方负给付义务，另一方只享有权利的合同，为单务合同。现实生活中的合同大多数为双务合同，如买卖、互易、租赁、承揽等。这类合同的每一方当事人即是债权人，也是债务人，他所享有的权利，正是对方所负的义务，他所负担的义务，正是对方享有的权利。双务合同与单务合同之区分，其意义在于合同履行时适用的规则不同。双务合同有对待给付及同时履行抗辩等规则，而单务合同则没有。双务合同一般为诺成合同，单务合同原则上为实践合同。
