农用土地租赁经营


农用土地租赁经营在土地所有权不变的情况下,农用土地所有者将土地的使用权、经营权、支配权在一定时期内有偿出租给承租人使用的经济行为。土地有偿使用的一种形式一般是非本农业集体经济组织的成员与本农业集体经济组织签订租赁合同,经营本农业集体经济组织所有的或者国家所有由本农业集体经济组织使用的土地。有的土地承包也采用租赁经营方式。农用土地租赁经营特征如下:①出租人不转移土地所有权,租赁关系(合同)解除以后,承租人将承租土地返还出租人。②租赁双方通过合同明确各自的责、权、利,承租人按合同规定向出租人交纳租金。③出租人除对土地质量和基础设施施行监督外,不干涉承租人对土地的经营和使用,承租人享有充分的经营自主权,对土地农用范围内的使用方式、利用率和产出率可以通过合同约定,也可以不约定。④租金数额多少完全取决于市场法则,双方自由确定。由于各地条件不同,土地租赁经营的形式各异。有的地方将所有承包地分等定级后实行租赁,统一收取租金;实行双田制(口粮田、责任田)的地方,责任田实行租赁;在工业、服务业比较发达、劳动力转移较快的地方,将土地集中连片,采取租赁形式承包;在城镇郊区蔬菜种植区,采取租赁形式租赁菜地;对于荒山、荒地、荒水等的开发或小流域综合治理,也有实行租赁经营方式。
