【土地使用权经营性转让】包括以下两大类:第一类是投机原因转让土地使用权;第二类是破产原因转让土地使用权。不论是投机原因还是破产原因的土地使用权的转让，都必须到土地管理部门重新登记，转让才有效。1.投机原因的土地使用权转让。社会经济的发展引起土地需求增加，而土地供给量有限，这就必然导致土地价格上涨。而这种情况下，土地原使用者通常会转让他的土地使用权，当然此时的地价会高于他购买土地使用权所支付的价格。土地转让价取决于两个因素:一是要看当时整个地价水平，二是土地原使用者所经营项目的赢利状况。投机原因的土地转让往往采用协议的形式。2.破产原因的土地使用权转让。土地原使用者经营状况恶化，收不抵债时，他就会转让土地使用权。破产原因的土地转让通常采用拍卖的形式。
