There is no stipulation of counterplea and counterclaim which debtors resist assignees when creditor rights are transferred in pending actions in the present legislations,we can not reach a common understanding in judicial practice,so there are many problems.
诉讼系属中债权转让时 ,债务人对受让人的抗辩与反诉 ,由于我国现行立法无明文规定 ,致使司法实践中认识不能统一 ,存在诸多问题。
