| 犯罪集团 criminal gang 三人以上为了实施一种或几种犯罪而组织起来的共同犯罪组织。它是共同犯罪的一种特殊形式。 构成犯罪集团须具备下列条件：①必须是三人以上，重要成员固定或基本固定，并有明显的首要分子；②有共同的目的、计划、分工和较固定的组织联系；③犯罪集团组成的目的，一般是为了进行一种或几种需要较多的人或较长的时间才能完成的重大犯罪活动。 犯罪集团主要有反革命集团、走私集团、投机倒把集团、拐卖人口集团、抢劫集团、盗窃集团、诈骗集团、贪污集团、流氓集团、贩毒集团等。由于犯罪集团较之单个人犯罪或其他共同犯罪，具有更大的社会危害性，因此，处刑也较重。在中国，对犯罪集团的首要分子，除刑法分则明文规定了较重的法定刑以外，都应从重处罚；对其他主犯也应从重处罚；对从犯，比照主犯从轻、减轻处罚或者免除处罚；对胁从犯，则根据其犯罪情况，比照从犯减轻处罚或者免除处罚。 |
