国外与标准化有关的立法世界上有100多个国家建立了标准化机构，许多都依据国家的有关法律、法令开展标准化工作。各国标准化法律、法规一般以皇家法令、政府法令、总统法令等形式颁布。例如，俄罗斯有《标准化法》。日本、韩国有《工业标准化法》，波兰有《标准化与认证法》。有的国家没有专门的标准化法律、法令，而是通过其他一些法律、法令对标准化作出规定。例如，美国联邦政府有关部门，按美国宪法行政卷第5编第2节行政程序的规定制定国家标准；美国国家标准学会，根据同政府的协议负责制定自愿性国家标准；美国国防部门。依照美国法典军事卷第10篇“武装力量”第2451—2457节《编目与标准化法案》和美国国防部标准化管理条例制定军工标准；美国的一些行业协会、学会等，根据团体法人登记的相关规定制定自愿性团体标准。1996年。美国立法机关将政府与民间团体在标准化方面应密切合作的要求写入了《国家技术转让和技术进步法》，第12条款规定：所有联邦机构在承担采购任务或制定政策目标时必须使用标准制定组织制定或转化采用的技术标准；只有当标准与现行法律不一致或不使用的情况下方可不使用标准制定组织的标准；联邦机构相关部门应与标准制定组织密切合作。并派员参与技术标准制定工作；赋予美国国家标准技术研究院(NIST)协调联邦政府、州和地方标准及合格评定，以及民间机构类似活动的职责。英国是最早用皇家宪章形式确定标准化机构、职能以及标准法律地位的国家。1929年4月22日按皇家宪章组建“英国工程标准学会”。1931年改名为“英国标准学会”。英国《合同法》规定英国标准学会(BSI)标准为贸易合同引用时，具有法律效力，违反者受法律制裁。日本于1949年颁布《工业标准化法》，1950年颁布《关于农林物资标准化与质量标志合理化法律》。 国际标准化组织、各国标准化机构以及标准化团体制定的标准中，涉及医药、安全卫生、劳动保护、环境保护等方面的标准，各国均用法律引用或法律规定的方式强制执行。例如，由美国国防部、农业部、环境保护署、食品药物管理局制定的标准，大多数具有强制性。1972年lO月，美国颁布的《消费品安全法》，规定成立消费品安全委员会，负责制定消费品安全方面的标准，这些标准是强制性的。俄罗斯1992年颁布的《标准化法》。明确采用强制标准与自愿标准相结合的体制。
