承租人要求出卖人交付标的物的权利:《合同法》第239条规定:“出卖人应当按照约定向承租人交付标的物”。解释如下:出卖人作为买卖的一方当然负有按照约定的时间、地点、方式、期限等交付标的物的义务,并且在融资租赁中出卖人交付标的物是其收取价款的前提,但在融资租赁中,出卖人的对方当事人虽为出租人,其交付标的物的义务却应向承租人履行之,此为约定的代出租人履行交付义务,出卖人未按约定向承租人交付标的物的,为违约行为,应负担违约责任,承租人可以要求出卖人继续履行交付义务,也可以解除合同,并要求赔偿损失。
