| 送达 service of process 司法机关按照法定方式，将诉讼文书交付给应当收受文书的当事人和其他诉讼参与人的诉讼行为。送达诉讼文书必须有送达回证，由受送达人在送达回证上记明收到日期，签名或者盖章。 在中国，一般情况下送达由法警进行。书记员或审判人员在法院内或因工作在法院外遇应受送达人时，也可自为送达行为。送达以对应受送达人直接进行为原则。 《中华人民共和国刑事诉讼法》规定，送达传票、通知书和其他诉讼文件（包括起诉书、免予起诉书、裁定书和判决书等），应当直接交给应受送达人；应受送达人不在，可以由他的成年家属或者所在单位的负责人代收。以上称直接送达。应受送达人或代收人拒绝接受或拒绝签名、盖章时，送达人可以依法采用留置送达的方式。即由送达人邀请应受送达人或代收人的邻居或其他见证人到场，说明情况，把文件留在他的住处，在送达证书上记明拒绝的事由、送达日期，并由有关人签名。 中国《民事诉讼法》规定的送达方式 ，共计5种，除直接送达、留置送达同刑事的送达相同外，还有：①委托送达。对居住外地的当事人和其他诉讼参与人送交诉讼文书，由受诉人民法院委托应受送达人居住地辖区的法院代为送达。对不在中国居住的当事人送交诉讼文书，分别情况，可以依中国缔结或共同参加的国际条约中规定的方式送达，也可以委托中国驻该国使、领馆代为送达，依协议委托外国法院代为送达，或通过外交途径送达。②邮寄送达。直接送达和委托送达有困难的，可以邮寄送达。邮寄送达以挂号回执上注明的收件日期为送达日期。对住在外国的人采取邮寄送达，以该住在国不反对邮寄送达为限。③公告送达。应受送达人下落不明，又无代收人，或用其他方式也无法送达的，采取张贴通告、登报或广播的方式公告送达；自发出公告之次日起，经过60日，满法定期限，即发生送达效力。如宣告失踪人死亡，自发出寻人公告即发生送达效力，1年后，如公告寻找的人未出现即可依法宣告死亡。 |
