【雇主责任保险】个人责任保险的一种。承保被保险人(雇主)的雇员在受雇期间从事工作时因遭受意外事故导致伤、残、死亡或患上与职业有关的任何疾病而依法或根据雇佣合同应由被保险人承担的赔偿责任。因上述原因所致的有关诉讼费用及其他必要费用也在保险责任范围内。各行各业的雇主是被保险人。雇主必须将其全体雇员同时投保,而不能只挑选一部分人员投保,但被保险人本人及其亲属不在保障范围之内。除外责任包括:战争、暴动、核风险引起的人身伤害;雇员由于疾病、传染病、分娩、流产以及因这些原因而施行内外科手术所致的伤残或死亡;雇员自残行为所致的伤残或死亡;被保险人的故意行为或重大过失,造成其雇员的人身伤害。雇主责任保险承保依据一般法律(通常为民法侵权行为)规定,应由雇主承担的赔偿责任,与寿险人身意外伤害保险和劳动行政部门办理的因工伤亡事故的保险,在保险原理上是截然不同的。
