劳动争议纠纷是指劳动关系双方当事人、即用人单位和与之形成劳动关系的劳动者，在劳动过程中因实现劳动权利和履行劳动义务而发生的纠纷。在私营企业、外商独资企业也称为劳资纠纷。
劳动争议纠纷具有以下特征：
①劳动争议纠纷的主体是特定的是劳动者。
②劳动争议纠纷主体之间必须存在劳动关系，而且劳动争议是在这种劳动关系存续期间发生的。
③劳动争议主体纠纷之间存在单向隶属关系，即用人单位和劳动者在劳动过程中存在管理与被管理的关系。
④劳动争议纠纷的内容必须是与劳动权利义务有关，即因劳动就业、劳动合同、劳动报酬、工作时间与休息休假、劳动安全卫生、社会保险与福利、职业培训等问题而引起的争议。
因此，用人单位之间；劳动者之间；用人单位与没有建立劳动关系的劳动者之间；用人单位与劳动者之间不是因劳动权利义务而产生的其他纠纷，都不属于劳动争议纠纷。
