,叫召二卜刁.,口U健纷1平J民事法律关系范畴保险代理合同属于因而保险代理合同的客饭与民事法律关系的客体趋于一致。一般而言,民事法律关系的客体是指民事法律关系主体在履行权利与义务时的共同指向。就保险代理合同而言,保险代理人与保险人权利与义务所指向的对象就是保险代理行为。所谓保险代理行为即指保险代理人从事的有意识的代理活动。如果没有这种由保险人授权进行的保险代理行为活动的客体的存在,保险代理合同也没有存在的必要了。因此,作为保险代理合同主体权利与义务所指向的对象,只能是保险代理行为本身。
