| 紧急避险 act to rescue 为了使国家、公共利益、本人或者他人的人身、财产和其他权利免遭危险，不得已采取的损害另一个较小的利益以保护较大的利益的行为。又称紧急避难。适用紧急避险必须具备下列条件。 危险方面的条件：①危险必须是确实存在的。这种危险可以是自然灾害、动物袭击、人的行为以及其他一切有可能发生实际危害的偶然事件。对于公职人员的合法行为、正当防卫行为，都不得视为危险而采取紧急避险措施。②危险必须是正在发生的。对于尚未到来或已经过去或假想的危险 ，不能适用紧急避险的规定。 避险方面的条件：益。为了保护非法利益，不能适用紧急避险。②必须是在没有其他办法排除危险而迫不得已所采取的行为。如果不是迫不得已，还有其他办法可以避免危险，就不能适用紧急避险。③紧急避险不能超过必要的限度而造成不应有的损害，即所造成的损害必须小于所保护的利益 ，不能大于或等于所保护的利益。 《中华人民共和国刑法》规定，紧急避险行为不负刑事责任；超过必要限度造成不应有的损害的，应当负刑事责任，但应当减轻或者免除处罚。①行为人实行紧急避险，必须是为了保护合法利 |
