根据国际习惯，军舰如在海上遇到台风、大雾、海流等自然界不可抗拒力的威胁，无法继续航行；发生破损、重大事故而航行困难；缺乏燃料、食品、以及出现危重伤病员无法医治和发生其他紧急情况，有权在没有得到有关国家允许的情况下，进入港口避难。紧急避难是一种迫不得已的临时措施。军舰在行使紧急避难权时，应尊重港口所属国关于港湾的各种规章制度和该国的风俗习惯，不得有损害该国和平、安全和良好秩序的任何行为，并应依照有关规定支付因得到救助（如停靠、加油、加冰、引水等）应付的各种费用。避难理由一旦消失，军舰应立即离开避难的港湾。
