A Research on the National Compensation System for Victims of Crime;

National compensatory system as a judicial safeguard measure for victim s legal rights, reflects the human governing ideas of national consoling victims, makes known national position of bearing national obligatory.

The national compensation system of the criminal victims prescribes that the victims or their close relatives, in certain condition, can claim economic compensation from the nation.

National compensation system for victims of crime is a system in which the nation use a special compensation fund already established or other capital to compensate those criminal victims who did not receive compensation through incidental civil actions or in the case the offenders was not captured.

In China,it is necessary to improve criminal victims’ right protection and relief by safeguarding victims’right to know judicial information,vest independent right of appeal in victims,expand the range of right to claim of damages for compensation,and establish national compensation system and victim assistance system.

This paper analyzes the defects of legal aid to criminal victims of China and the present situation of legal assistance,and then point out that the most effective approach of legal aid to criminal victims is to establish state compensation system.
