Civil procedure and administrative procedure supervision is an organ part of People’s procuratorate power given by Constitution.

From the contents of the prosecutorial power supervising ad- ministration, the author argues the existence rationality of prosecutorial power supervising administration, elaborating the main contents of it, pointing out the ways of establishment of exercising it by prosecutorial organization.

The procuratorial supervision in administration includes procuratorial organs supervision of specifically illegal administrative act and supervision of administrative litigation.

Therefore,the People s Procuratorate can carry out the prosecutorial supervision on community correction by means of prosecutorial suggestion,notice of correcting illegality and the right of case registration and investigation .

With the further development of research and practice of civil execution,some new kinds of problems concerning arbitration have emerged,including the problem of lacking laws to regulate the ways of prosecutorial supervision of civil enforcement,which leads to the chaos of implementing this system in practice.

The prosecutorial supervision of administrative litigation plays an important role in ensuring our legal and just action of administrative litigation.
