| 热审 中国明、清两代于夏季减等科刑的审判制度。目的是防止囚犯因暑热、瘟病流行而死于狱中。始于明成祖永乐二年（1404），开始只遣轻罪，命出狱听候，后来宽及徒刑、流刑罪以下。至成化年间，五月至六月，笞罪可以释放，徒刑可以减等；应枷号者可以免。后逐渐形成制度。清承明制 ，热审于顺治八年(1653)即已实行，于乾隆年间定制。每年小满后十日起至立秋前一日止实行热审。如立秋在六月内，则七月初一止。一般犯罪除死罪、军流及窃盗、斗殴伤人等罪不准减免外，杖罪人犯各减一等，笞罪宽免，应予枷号者暂行保释，立秋后再依法减等补施。但热审期内审定，逾热审期而发落者，均不适用减免。明代还偶有在冬寒季节减等科刑制度，以免囚犯因饥寒死于狱中，称寒审。 |
