| 亲亲相隐 中国封建刑律的一项原则，亲属之间有罪应当互相隐瞒，不告发和不作证的不论罪，反之要论罪。实行这项原则，是为了维护封建伦常和家族制度，巩固君主专制统治。亲亲相隐本是春秋战国时期儒家提出的主张。三国、两晋、南北朝时期，亲亲相隐原则进一步得到确认。唐律对亲亲相隐原则作了具体规定，以后各朝的规定大体上与唐相同，其内容主要有3点：亲属有罪相隐，不论罪或减刑；控告应相隐的亲属，要处刑；有两类罪不适用亲亲相隐原则：一类是谋反、谋大逆、谋叛及其他某些重罪，另一类是某些亲属互相侵害罪。 |
