民事执行是指法院执行组织按照法定程序将已经发生法律效力的判决和裁定及其他法律文书的要求加以实现，强制负有民事义务的当事人完成义务的活动。其主要特点是：
1.执行的根据是已经生效的应由法院强制执行的具有给付内容的法律文书；
2.当事人拖延或拒绝履行生效法律文书确定的义务；
3.具有强制性。执行应当制作执行书，并须随付判决书或裁定书，执行完毕就结束了整个诉讼程序。执行机关为实现法律文书所规定的内容而采取的具体办法，简称执行措施。
