| 交通运输法 transportation,laws of 调整交通运输关系的法律规范的总称。交通运输关系包括交通运输管理关系和交通运输合同关系。交通运输包括铁路、公路、内河、沿海、远洋、航空及管道运输等。各国运输立法一般包括公路运输立法，铁路运输立法，内河、沿海、远洋运输立法和航空运输立法。 中华人民共和国建立后，先后制定了一系列调整各种运输关系的单项法规。1990年9月7日第七届全国人大常务委员会第十五次会议通过的《中华人民共和国铁路法》，是调整铁路运输企业与旅客和托运人之间运输关系的基本法律。水上运输方面重要法律、法规有：《中华人民共和国海上交通安全法》、《中华人民共和国内河交通安全管理条例》、《中华人民共和国水路运输管理条例》、《中华人民共和国航道管理条例》等，对旅客和货物运输、事故处理等作了规定。公路运输方面的重要法规有：《中华人民共和国公路管理条例》及其细则，《公路汽车货物运输规则》、《公路汽车旅客运输规则》等。调整航空运输关系的法规有：《中华人民共和国民用航空器适航管理条例》、《外国民用航空器飞行管理规则》、《国内航空运输旅客身体损害赔偿暂行规定》、《国内旅客运输规则》和《国内货物运输规则》等。 中国交通运输法律法规除规定当事人的权利义务外，具有下列特点：①计划运输原则。为了保证国民经济按比例地协调发展，要求各种运输活动按照国家下达的运输计划组织均衡运输。②合理运输原则。为有效使用各种运输工具的运能，对对流运输、过远运输、重复运输等不合理运输，作了限制性规定。③统一管理原则。交通运输业由国家有关部门统一管理，货物运价和票价由有关部门统一规定，双方当事人必须遵守执行。 由于交通运输活动具有国际性，国际上制定了一些交通运输公约和规则。如1924年《海牙规则》，1970年《国际铁路货物运输公约》，《国际铁路货物联运协定》等。中华人民共和国参加的国际公约有：《统一国际航空运输某些规则的公约》、《海牙协定书》和《联合国国际货物多式联运公约》等。 |
