【让与】指将自己的物或权利转移给他人的法律行为。 在不违背法律规定的前提下，债权、所有权及其他权利均可通过合同的形式有偿或无偿地让与。债权的让与，通常只涉及债权人的变更而不影响债务人所承担的义务，除另有约定者外。这种让与一般不需要取得债务人的同意，但让与人或受让人应将让与的协议通知债务人，方能对债务人生效。在债权的让与中，让与人只对债权的存在承担责任，对债务人所负履行债务不负责任。担保债务履行的抵押权、保证权以及利息等从属权利，随同债权一并转让给债权受让人。与人身不可分离的权利(如赡养权、继承权)不得让与。物权的让与，如为不动产，应用书面合同并须依法登记。如为动产，一般应将该动产交付受让人占有。
