| 非法人团体 unincorporated society 设有代表人或管理人而不具备法人资格的独立社会组织。非法人团体与法人的分支机构不同。法人的分支机构虽设有代表人或管理人，但不是独立的社会组织，有的也不能以分支机构的名义起诉、应诉。而非法人团体在各国一般都被赋予诉讼当事人资格，允许它以自己的名义起诉、应诉。 在中国的现行立法中，有的将非法人团体称为非法人单位，有的称为其他组织。非法人团体主要有以下几种：①个体工商户和农村承包经营户。②个人合伙。③合伙型联营企业。④中国企业、事业单位、机关、团体的分支机构、派出机构；外国企业和组织在中国设立的分支机构、派出机构。⑤不具备法人条件，没有取得法人资格的乡镇企业和街道企业。⑥作为企业内部承包合同一方的车间或班组。非法人团体不是民事权利主体，无权利能力，但它既然客观存在，就要从事各种民事活动，活动中就不可避免地发生纠纷，形成诉讼。因此，在法律上赋予它以起诉、应诉的资格，承认它在民事诉讼中的当事人地位。它的代表人或管理人为其法定代表人，在诉讼中的地位适用法人法定代表人的有关规定。 |
