An inquiry is made into the relation between collecting fees by procuratorate in cases of appeal and counter appeal and the procuratorial authority to supervise; and the influence on society, which must not be underestimated.

Our current Criminal Procedural Law has taken some measures to safeguard the rights of the victims in public prosecution cases,and give them the position of the party concerned and extremely extensive litigation rights,but it doesn t give them the appeal right which they should have as one of the most important litiga.

In our country,the present criminal Law determines the litigant s and the victim s main body status in the public prosecution case,but it does not endow them with appeal right.

Trial by combining private prosecution cases with public prosecution cases should take the trial process of public prosecution case as the main part,and the trial process of private prosecution case as the supplement.
