The intellectual property and the licensing of intellectual property are of significant importance in market competition and social development with the creation, spread and use of knowledge.
二十一世纪是以科技创新为基础而展开竞争的知识经济时代,随着科学技术的不断发展,社会对科学技术的运用程度以及依赖程度也在不断提高,知识的创新、传播及运用,使得知识产权、以及知识产权许可在市场竞争、社会发展中的地位和作用也越发显示出其特有的重要性,特别是在市场竞争模式由资本竞争向知识、技术竞争转变的当今世界,知识产权的许可日趋频繁和复杂,因此对知识产权许可领域中有关知识产权保护、权利行使规制等相关问题也日益受到社会各界以及法律的关注,尤其是在许可中涉及限制性条款的合法性审查问题更为学界所重视。

Having regard to the level of research on licensing of intellectual property in China, the author attempts to establish uniform theory on licensing of intellectual property through composing this dissertation.
考虑到我国目前知识产权理论界把许可问题归入具体知识产权来研究的现状,笔者希望能通过本文的撰写为整个知识产权许可问题提供一个一般的理论框架,同时对其中的基本法律概念作出相应的比较和分析,以期对知识产权本身和知识产权许可制度都有更深刻的理解。
