商标侵权对他人依法取得的商标专用权所实施的侵害行为。各国商标都旨在用法律手段制止和制裁一切侵犯商标专用的行为，以维持社会经济秩序。中国《商标法》把商标侵权行为归为以下3种:①未经商标注册所有人的许可，在同一种或者类似商品上使用与其注册的商品相同或者近似的商标。②擅自制造或者销售他人注册商标标识(商标标识是商标的载体，即商标的物质表现形式)。③给他人的注册商标专用权造成其他损害的，主要包括:经销侵犯他人注册商标专用权的商品;在同一种或者类似商品上，将与他人注册商标相同或相近似的文字、图形作为商品名称或者装演使用，并足以造成误认的;故意为侵犯他人商标专用权的行为提供仓储、运输、邮寄、隐匿等便利条件的。此外，如在商品广告或展览中低毁他人商标信誉等，也是侵权行为。
