Considering that the drafting of China s Real Rights Law is conducted in a strong atmosphere of private law,this article attempts to discuss the registration of real estate from the public law s perspective,which includes the registration office,the nature,value,function of real estate registration,and related judicial review.
鉴于我国《物权法》的起草是在带有极强的私法色彩和氛围下进行的,本文尝试从公法角度对不动产登记机关,不动产登记的性质、价值和功能,以及与之相关的司法审查等问题进行初步分析,以期能对物权法的制定提供有益的参考。

登记主管机关监督管理
是指登记主管机关对所辖企业法人及经营者应负的管理职责。监督管理的主要内容是：
1.监督企业法人按照《条例》及其施行细则的规定办理开业、变更和注销登记；
2.监督企业按照核准登记事项以及章程、合同或协议从事经营活动；
3.监督企业和法定代表人的违法经营活动；
4.监督企业按照规定办理年检手续。
登记主管机关主要通过年检、验证、查处企业的违章违法行为以及向企业宣传国家有关法律、法规和政策来实现监督管理。
