It is true that land ownership and the use of land are separated, but how to obtain the right to use land with a reward? According to the regulations of land administrative laws, it takes three forms: to sell the ownership of land, to lease land, to invest or to buy a share of land.
土地所有权与使用权的分离已成为事实,但如何有偿取得土地使用权?依《土地管理法实施条例》第29条规定,分为土地使用权出让、土地租赁、作价出资或者入股三种方式。

出让土地使用权的权利：国家以所有者的身份，将一定的国有土地使用权，有期限的让与土地使用者并由土地的使用者向国家支付土地使用金的行为，土地使用权出让的法律特征为：（1）、出让方的主体资格特定，只能是国家，（2）、土地使用权出让是有偿、有期限、附条件的土地使用权的转移，（3）、土地使用权的出让属于要式的法律行为。（4）、土地使用权出让法律关系是国家与用地者之间的一种资源分配关系，不适用一般民事合同的原则，土地使用权出让的方式主要有协议、招标和拍卖。《法学大辞典》第一版，第54页，邹喻主编，中国政法大学出版社。
