保险经纪人指在保险人与投保人之间联系保险业务的中间人，他代表被保险人与保险人进行协商以订立保险合同。保险经纪人一般都是具有一定的保险专业知识和技能的人。他对保险人员有交付保险费的责任，但并不保证保险人的偿付能力，对给付保险赔款和退费也不负法律责任。习惯上，保险经纪人为保险人介绍业务，而由保险人按保险费的一定比例给付报酬，即佣金。中国《保险法》对保险经纪人作了明确规定。在再保险市场上，有再保险经纪人，专门从事为保险人联系和安排再保险业务。在国际保险市场上.英国保险经纪人的力量最强，这是与英国独特的历史传统相联系的。按照劳合社的商业习惯，海上保险合同的签订均须由保险经纪人之手.由他代投保人申请保险，支付保险费，并处理以后发生的赔偿问题。关于保险费的支付，由保险经纪人直接对保险人负责，保险人不得要求投保人支付。但赔偿和保险费的返还，则由保险人直接对被保险人负责。这种独特的商业习惯，造就了一大批保险经纪人。在中国，只有再保险业务和涉外保险业务才有通过外国的保险经纪人进行保险业务的作法。近年来，随着国内保险市场的逐渐形成，已有相当数量的保险经纪人出现在市场上。
