经济合同纠纷当事人双方对经济合同履行的情况和对不履行或不完全履行经济合同的后果产生的争议。对合同履行情况产生争议，是对合同是否履行或是否按约履行产生分歧;对不履行或不充分履行合同的后果产生争议，是对没有履行或没有完全履行合同的责任由谁承担、承担多少产生分歧。在中国，根据有关法律规定，解决经济合同纠纷的主要方式有:①当事人自行协商解决。就是由经济合同当事人双方依据国家法律、法规、政策的规定，在平等、自愿、互谅的基础上，通过双方协商解决合同纠纷。这种方法简便，不需要经过诉讼程序或仲裁程序，能及时解决纠纷。②业务主管部门调解解决。业务主管部门对本系统内各单位的经济合同纠纷，可以按照双方的意愿，根据国家法律、法规和政策及有关情况，做一些说服教育工作，促使双方达成调解协议。③经济合同仲裁。经济合同仲裁机构是国家各级工商行政管理机关设立的经济合同仲裁委员会。只要一方当事人向仲裁机关申请，仲裁机关即应依法予以受理。仲裁机关解决争议采用先调解后仲裁程序。调解未达成协议或调解书送达前一方或双方翻悔的，则由仲裁庭进行仲裁。④法院审判。各级法院均设有经济庭，按《民事诉讼法》规定的程序，审理经济合同纠纷案件。
