中国关于在对外公务活动中蹭送和接受礼品规定 为了加强对国家机关工作人员在对外公务活动中赠送和接受礼品的管理，严肃外事纪律，保持清廉，国务院于1993年12月苏日发布了《关于在对外公务活动中赠送和接受礼品的规定》。《规定》要求:①根据国际惯例和对外工作需要，必要时可以对外赠送字七物。对外赠送礼物必须贯彻节约、从简的原则，礼物应当以具有民族特色的纪念品、传统手工艺品和实用物品为主。②对来访的外宾，不主动赠送礼物。外宾向我方赠送礼物的，可以适当回赠礼勿。③对外赠送礼物或者回赠礼物，必须经国务院所属部门或省、自抬区、直辖市人民政府批准，或者由其授权的机关批准。审批时，应当从严掌握。④在对外公务活动中接受的礼物，价值按中国国内市价折合人民币20。元以上的，自接受之日起(在国外接受礼物匀，自回国之日起)一个月内填写礼品申报单，并将应上缴礼物上缴字L品管理部门或受礼人所在单位;不满 200元的，归受礼人本人域者受礼人所在单位。在对方赠送礼金、有价证券时，应当予以谢色;确实难以谢绝的，所收礼金、有价证券必须一律上缴国库。⑤在对外公务活动中，不得私自接受礼品，不得以明示或者暗示的方斌索要礼品。⑥国家机关工作人员在公务活动中向华侨和港澳台阔胞赠送和接受礼品，也依照本规定执行。⑦国家机关工作人员违反本规定的，对负有直接责任的机关有关领导人和直接责任人给予行政处分;构成犯罪的，由司法机关依法追究刑事责任。国家行迫监察机关按照有关规定，负责对对外赠送和接受礼品的情况进书监督、检查。
