法律适用是指国家机关及其工作人员依其职权范围和法定程序，把法律规范应用于具体的人或组织，使法律规范在现实生活中得到实现的专门活动，是实施法律规范的重要方式。我国社会主义法律适用是国家活动的重要组成部分。检察机关和法院，是运用法律的专门机关，有权依法处理各种刑、民、行政等案件；行政机关在其职权范围内，有权运用行政法规。对适用法律的基本要求是：正确、合法、及时。其基本原则是：以事实为根据，以法律为准绳；公民在适用法律上一律平等。
