发包人要求承包人建设工程负瑕疵担保责任的权利：承包人对其施工建设的工程质量负有瑕疵担保责任，在工程质量保证期内，工程所有人或者使用人发现工程瑕疵的，有权直接请求承包人修理或者返工、返建，为了保证建设工程的质量，当事人可以约定保证金，当事人双方在合同中预定质量保证金的，发包人于支付价款时得扣留约定的保证金，发包人所扣留的质量保证金，在质量保证期内不欲归还。只有在保证期届满后，未发现工程瑕疵或者虽有瑕疵但承包人进行了维修或返工，改建验收合格时，发包人才归还质量保证金。关于质量保证期限，当事人可以在承包合同中约定，也可以在单独的保修合同中约定，质量保证期限应当与工程的性质相适应，不能过短，保证期限应自发包人在最终验收记录上签字之日起算；分单项验收的工程应分别计算质量保证期限。《民法》第一版、魏振瀛主编 北京大学出版社
