执行异议是指在执行过程中，没有参加执行程序的案外人对执行标的主张权利，提出不同意见。案外人提出异议的，执行人员应当进行审查，理由不能成立的，予以驳回，执行程序继续进行。理由成立的，应当报院长批准后中止执行程序，然后由合议庭审查或者由审判委员会讨论，如果发现判决裁定确有错误的，按照审判监督程序处理。
