建筑业用工制度建筑业招用职工(固定工、合同工、临时工)的构成模式及其使用过程中的管理方式。又称建筑业劳动制度。中国建筑业长期实行多种用工制度，以固定工为基本力量，以合同工为机动力量。1978年以来，国家对建筑业用工制度进行了改革。1984年城乡建设环境保护部和劳动人事部颁发了《国营建筑企业招用农民合同制工人和使用农村建筑队暂行办法》。这使得用工制度改革很快在全国展开，从而使合同工、临时工的招用开始走上制度化的轨道，确定了以固定工为骨干，农民合同工为主体，农村建筑队为补充力量的弹性用工制度。随着建筑业体制改革的不断深化，用工制度在实践中不断完善。建筑业劳动管理的重点是:建筑施工队伍总量与固定资产投资规模大小相适应;加强劳动定额管理，提高劳动生产率;开展职工培训，提高队伍素质;健全劳动保护与安全措施，积极而稳妥地建立劳务基地和劳务市场。
