按照经济基础和阶级本质而划分的法的类别。凡是建立在同一经济基础之上，反映同一阶级的意志，维护同一阶级统治的法，属于同一类型。在人类历史上，法的类型可以分为4种:奴隶制法、封建制法、资本主义法、社会主义法。 前3种类型的法虽然在经济基础与阶级本质上各有差别，属于不同社会形态的法，但它们有着共同点，即都建立在以生产资料私有制为核心的经济基础之上，反映剥削阶级的意志和利益，维护剥削阶级的统治，所以都是剥削阶级类型的法。社会主义类型的法建立在生产资料社会主义公有制的基础上，反映无产阶级领导的广大人民群众的意志和利益，维护无产阶级的统治，是新的最高类型的法，也是人类最后一种类型的法。各个国家的法， 一般是要按以上4种类型的顺序发展的，但也有少数国家是从原始社会直接过渡为封建社会，因而首先出现的是封建制法。法的类型适应社会经济形态的发展变化而发展变化，由于社会主义社会必将进入共产主义社会，社会主义类型的法将不是由另一种类型的法所代替，而是随着客观条件的逐渐成熟最后走向消亡（见法的消亡）。
