| 审判公开 open trial 法院审判案件公开进行的诉讼原则。开庭时间、地点对外公开，允许公众旁听和新闻记者采访。审判公开原则最早为资产阶级启蒙学者所提出，以反对封建司法中的秘密审判、私设法庭、专横擅断。后为各国普遍采用。在中国，依照法律规定，人民法院审理案件应当公开进行。但下列情况不公开审判：①涉及国家机密、个人隐私案件，一律不公开。②未成年人的犯罪案件，14岁以上不满16岁的一律不公开；16岁以上未满18岁的，一般也不公开。③离婚案件当事人申请不公开审理的，可以不公开。上述案件不论是否公开审理，宣告判决一律公开进行。 |
