In practice,professionalism of judge,jurisdiction independence and judicial review have tendency departing from the Democracy.

As the professional appearance characteristic of modernization of judiciary, professionalism of judge is its inevitable request and precondition, and also has important effect on it.

But simultaneously,the justice has a tendency departing from democracy,such as professionalization of judge has a tendency departing from democracy,judicial independence excessively independents justice from the society and the populace,causing judges isolation,the judicial review is also not accommodating with democracy and so on.

However, the collegial panel becomes a mere formality, which is a barrier to the process of professionalization of judge in our country.

With progress to rule by law of our country, judicial reform is gaining more andmore attentions from the society and the issue of professionalization of judge which isa hotspot of this reform has become a difficult and important task.

In our country,the constuction of judge professionalism has three flaws: idea lack of outstanding person,lack of institutional independence,and lack of legal methodology.

As one of the major themes of the judicial reform and development in China,judge professionalism is really a magnificent and complicated issue,which calls for the brains-racking selection of stand and strategy institution such aspects as ideal,pro status,objectives and methodology.

On the one hand,we insist on judge professionalism;on the other hand,more emphasis should be put on the application of non-professional justice elements to serve for ruling-by-law.

As the judicial reform goes ahead, judge system reform, especially the specialization of the judges comes to the main research topic.
