This paper investigates Chinese recidivism system,and then puts forward some proposals as followings: the definition of the particular recidivism should be broadened; the unit ought to become the body of recidivism;juveniles can not be recidivism;the penalty that has been completed ought to consist of principal penalty and accessory penalty,and so on.
考察我国累犯制度,提出扩大特殊累犯的范围、单位成为累犯的主体、未成年人不构成累犯、刑罚执行完毕的刑罚应包括主刑和附加刑等看法。
