国际投资争端仲裁解决国际投资纠纷的一种方式一般分为国家仲裁和国际仲裁;临时仲裁与常设仲裁。 临时仲裁指根据双方当事人的协议，通过直接指定仲裁人，自行组成仲裁庭进行仲裁，争端处理完毕做出仲裁后，仲裁庭即自行解散常设仲裁指由常设仲裁机构进行裁决，常设仲裁机构有团定的组织和仲裁规则，能为当事人提供较多的便利条件。为了更好地解决日益增多的国际投资纠纷，1965年由国际复兴开发银行主持签订了《关于解决各国和其他国家的国民之间的投资争端的公约》，世界上许多国家都加入了这一公约。从而为解决投资纠纷的国际仲裁提供了依据和便利。
