| 反致 remission 按照甲国的国际私法规则（抵触规则）应适用乙国法，而按照乙国的国际私法规则却应适用甲国法的情况。如果按照甲国的国际私法规则应适用乙国法，而按照乙国的国际私法规则却应适用丙国法 ，就形成了转致 。“致”就是送，“反致”就是送回，“转致”就是转送。反致和转致都是由于甲乙两国的国际私法规则所采用的连结根据不同，并且甲国在适用法律时顾及了乙国的国际私法规则而发生的法律问题。如果没有这两个条件同时存在，就不发生反致和转致。 |
