| 《关于向国外送达民事和商事司法文书和司法外文书公约》 Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters 1965年11月15日订于海牙。1970年3月5日生效。截至1992年5月31日，共有缔约方29个。中国于1991年5月3日加入《公约》。《公约》共3章，31条，2个附件。第一章是司法文书。第二章是司法外文书。第三章是一般条款。附件1是向国外送达司法文书和司法外文书的请求书和证明书表格。附件2是被送达文书概要。 《公约》适用于民事或商事案件中向国外送达的司法文书和司法外文书。《公约》规定，每一缔约国应指定一个中央机关，负责接收来自其他缔约国的送达请求书，并予以转递。如文书发往国中央机关认为该请求书不符合《公约》的规定，应及时通知申请者，并说明其对请求书的异议。对于符合《公约》规定的送达请求书，文书发往国只有在其认为执行请求将损害其主权或安全时才可拒绝执行，并应迅速通知申请者和说明拒绝的理由。《公约》规定的送达途径有外交途径和领事途径，如果送达目的地国不持异议，还可通过邮寄方式，或通过负责送达的官员或诉讼利害关系人的方式，或通过缔约双方议定的直接送达方式送达。 |
