农户承包经营权


  农户承包经营权农户在法律和合同规定的范围内,对集体所有的或者国家所有由集体使用的土地和其他集体资产的占有、使用、收益和部分处分的权利。《中华人民共和国民法通则》第八十条第二款规定,农户对土地的承包经营权受法律保护,承包双方的权利和足务依照去律由承包合同规定农户承包经营权来源于集体所有权和使用权,并通过农业承包合同而取得。尽管承包经营权是因合同而产生的,但它并非债权,而是一种物权,即与财产所有权有关的财产权。承包经营权包括以下四项权能:①占有权,即承包经营户对承包资产有实际控制的权利。②使用权,即承包经营户有按合同或法律规定的用途对承包土地及其他集体资产进行利用的权利。③收益权,即承包经营户有收获或转让产品的权利。④部分处分权,根据有关法规规定,承包经营户享有转包、转让的权利。当然,在行使转包和转让的权利时须经发包人同意。任何单位或个人均不得阻碍承包经营户行使上述四项权能。作为承包经营权的主体—承包经营户,必须是本农业集体经济组织的成员,可以是个人、农户、联户或由个人组成的专业组。
