《承认和执行外国仲裁裁决的公约》
《承认和执行外国仲裁裁决的公约》1958年6月10日在纽约联合国经济及社会理事会召开的国际商事仲裁会议上通过和缔结，简称《1958纽约公约》。该公约是当今承认和执行外国仲裁裁决的具有普遍性的公约。中国于1986年12月2日通过加入该公约的决定，1987年4月22日该公约对中国生效。公约共16条，就缔约国承认及执行外国仲裁裁决的义务和条件作了统一的规定，主要内容为:①缔约国必须相互承认对方国家的仲裁裁决的约束力，并且依照裁决需其承认或执行的地方的程序规则和公约规定的条件执行;在承认和执行对方国家的仲裁裁决时，不应提出比承认和执行本国仲裁裁决更为苛刻的条件或征收更多的费用。②申请另一缔约国承认和执行仲裁裁决的当事人，应提供经过适当证明的仲裁裁决书的正本或副木，必要时应附具译本。③拒绝承认与执行外国仲裁裁决的条件。此外，公约允许各国加入时在互惠的基础上承认和执行在缔约国领域内作出的仲裁裁决(即互惠保留声明)和声明只承认和执行属于商事的仲裁裁决(即商事保留声明)。中国在加人该公约时也作了以上两项保留声明。
