[再保险合同】再保险合同又称分保合同。它是分出公司和接受公司为实现一定经济目的而订立的一种在法律上具有约束力的协议。再保险合同是保险合同的形式的一种。再保险合同约定再保险关系双方的权利和义务，即分出公司必须按合同的规定将其承担的保险责任风险的一部分或全部分给接受公司，并支付相应的再保险费;接受公司向分出公司承诺对在其保险合同项下所发生的对被保险人的赔付，将按照再保险合同的条款和应由其负责的金额给予经济补偿。再保险合同规定了再保险关系双方的权利和义务，双方必须遵守并互相约束。 我国《保险法》第二十八条规定:“保险人将其承担的保险业务，以承保形式，部分转移给其他保险人的，为再保险。 应再保险接受人的要求，再保险分出人应当将其自负责任及原保险的有关情况告知再保险接受人。”
