On the basis of defining the connotation of information rights, this paper explains the ontology architecture of information fairness, through understanding the basic value idea of fairness, justice and equality.
在界定信息权利内涵的基础上,通过对公平、正义与平等基本价值理念的理解,阐释了信息公平本体架构,指出信息权利与信息公平的内在联系——信息权利的宣示与践行是实现信息公平的程序化保障,并从权利维度,提出构建信息公平的四项原则——公共利益优先原则、人权优先原则、权利平衡原则以及权利限制原则,继而以培育主体能力、建构服务网络、加强制度建设为进路,探寻实现信息公平的可行性路径,以期在构建信息公平社会进程中,使得信息公平关系模式化、具体化,让实质与程序意义上的信息公平找到现实的制度依托。

在界定权利与救济内涵的基础上,提出信息权利救济作为权利践行过程的制度设置,这是解决信息权利冲突的必然选择,并从权利救济与实体权利关系的维度,对信息权利救济机制——行政救济和司法救济——进行制度/模式分析,得出信息权利救济是信息权利实现的程序化保障,以期在建构信息权利保障体系过程中,对信息权利救济给予合理的、科学的审视与定位。
