采矿权使用费和价款的减免国家实行采矿权有偿取得的制度。采矿权使用费，按照矿区范围的面积逐年缴纳，标准为每平方公里每年１０００元。 采矿权人开采边远贫困地区的矿产资源、开采国家紧缺的矿种或因自然灾害等不可抗力造成矿山企业严重亏损或者停产以及存在国务院地质矿产主管部门和国务院财政部门规定的其他情形的，由采矿权人提出申请，经省级以上人民政府登记管理机关按照国务院地质矿产主管部门会同国务院财政部门制定的采矿权使用费和采矿权价款的减免办法审查批准，可以减缴、免缴采矿权使用费和采矿权价款。
